The Sexual Violence and Harassment Action Plan, is an important piece of legislation that introduced significant amendments to Ontario’s Occupational Health and Safety Act (OHSA).
These amendments established clear, enforceable obligations to prevent and address sexual harassment and violence in Ontario workplaces. Employers are required to take proactive measures to create harassment-free work environments.
What Is Workplace Sexual Harassment?
The definition of sexual harassment, aligning with the Ontario Human Rights Code, and includes:
- Unwelcome comments or behaviour based on sex, sexual orientation, gender identity, or gender expression.
- Sexual solicitations or advances from someone in a position of power, such as a manager or supervisor, where those actions are unwelcome.
Under section 32.0.7 of the OHSA, employers are required to develop and deliver workplace harassment prevention training for all employees, including managers and supervisors.
